DMCA Copyright Policy

Chevere SpA ("Chevereto", "we", "us", or "our") respects the intellectual property rights of others and expects users of Chevereto Cloud to do the same. This policy describes how we respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA").

1. How Chevereto Cloud Works

Chevereto Cloud is a Bring Your Own Storage (BYOS) platform. All media files uploaded through Chevereto Cloud are stored exclusively in the external storage infrastructure configured and controlled by the individual account holder, not on Chevereto's Cloud own servers. Chevereto does not retain copies of user-uploaded content on its infrastructure.

As a result, Chevereto is not the host of user content and cannot unilaterally remove files from a third-party storage provider. If you believe content accessible through a Chevereto Cloud-powered website infringes your copyright, the most effective path is to contact the operator of that website directly, as they control the storage in which files reside.

Nonetheless, upon receiving a valid DMCA notice, we will take appropriate action against the account holder in accordance with this policy and our Terms of Service.

2. Designated Copyright Agent

We have designated the following agent to receive notifications of claimed copyright infringement:

3. Submitting a Takedown Notice

If you believe that content accessible through Chevereto Cloud infringes your copyright, you may submit a written notification to our Designated Agent. To be valid under the DMCA, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  3. Identification of the material you claim is infringing, with sufficient detail for us to locate it (e.g., the specific URL).
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices that do not include all required elements may not be acted upon. Send your notice to: dmca@chevereto.com.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

4. Our Response to Takedown Notices

Upon receiving a valid DMCA notice, we will:

  • Promptly notify the account holder identified in the notice.
  • Take reasonable action against the account, which may include suspension or termination depending on the circumstances.
  • Forward the notice (including your contact information) to the account holder, as required by law.

Because Chevereto does not control the underlying storage, we cannot directly remove files from a third-party storage provider. We strongly encourage you to also contact the account holder and their storage provider independently to achieve the fastest removal of infringing content.

5. Counter-Notification

If you are an account holder and believe your content was disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be valid, your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Chevereto may be found), and that you will accept service of process from the person who submitted the original notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may, at our discretion, restore access to the affected account or content.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed by mistake may be liable for damages.

6. Repeat Infringers

Chevereto has a strict policy against repeat copyright infringement. In appropriate circumstances, we will terminate the accounts of users who are determined to be repeat infringers. We consider all available information, including the number of valid DMCA notices received, when making this determination.

7. Changes to This Policy

We may update this DMCA Copyright Policy from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Service after any changes constitutes your acceptance of the updated policy.
